Arbitral Tribunal Awards ₹7.75 Crore in Coimbatore Property Case

Coimbatore: A significant legal outcome unfolded recently as an arbitral tribunal mandated JMJ Housing Ltd. and its director to jointly pay ₹7.75 crore to Champion Textiles Ltd. This ruling emanates from a dispute over a residential development project and was issued on October 12, 2026.

Justice T. Ravindran, a former Judge of the Madras High Court, presided as the sole arbitrator in Arb. O.P. (Com. Div.) No. 394 of 2024.

At the heart of this case lies a Joint Development Agreement (JDA) for land in Pattanam village, Coimbatore district, signed on January 19, 2022. Champion Textiles, represented by Managing Director V.R.S. Natarajan, entered this agreement with JMJ Housing Ltd., whose director is Wilson P. Thomas.

The agreement tasked JMJ Housing with executing residential construction as per pre-specified terms. It also included provisions for sharing development benefits and property between the involved parties.

However, tensions soon escalated regarding the actual execution of the agreement, leading to discrepancies over construction responsibilities and concerning property plot transactions. Champion Textiles accused JMJ Housing of transferring several property plots to third parties, contrary to the established agreement and a General Power of Attorney.

The claimant also raised concerns about the lack of requisite composite agreements with prospective buyers before some property transactions were registered.

In response, JMJ Housing maintained that they had made significant preparatory investments in the project.

Following a thorough examination of the submissions, principle evidence, and testimony from both sides, the tribunal ruled in favor of Champion Textiles regarding critical contractual violations.

This ruling underscored the developer’s responsibilities, the contested property transfers, and the factors surrounding the related agreements executed between the parties.

In its verdict, the tribunal found the disputed transactions inconsistent with the contractual stipulations, thus ordering the cancellation of specified sale deeds.

The financial aspect of the ruling involves compensation summing up to ₹7.75 crore, broken down into two parts. JMJ Housing and its director must pay ₹6.75 crore, accruing interest at 18% per annum starting from March 13, 2025, until the amount is settled in full.

An additional ₹1 crore was awarded, also carrying an interest rate of 18% per annum from the date of the award until it is fully paid.

This compensation amount does not include interest or additional costs incurred. Furthermore, the tribunal ordered the respondents to cover the expenses related to arbitration proceedings.

Apart from the financial liabilities, the tribunal’s decision necessitates the cancellation of ten specific sale deeds associated with the aforementioned property.

Additionally, respondents 1 to 14 must deliver vacant possession of the property described in Schedule A of the award to Champion Textiles within one month from the date of the ruling.

These directives stem from the tribunal’s findings concerning the breaches of the development agreement and the questionable transfers involved.

The arbitration process revolved around conflicting claims regarding the responsibilities under the agreement, the development activities conducted, and the legitimacy of dealings with third parties.

Champion Textiles pursued the cancellation of disputed transactions while also demanding possession and monetary compensation. On the other hand, the respondents contested these claims and sought to have the proceedings dismissed.

This award, dated October 12, 2026, emphasizes the challenges associated with enforcing agreements in real estate. The legal repercussions and the practical implementation of the tribunal’s directives remain critical subjects for stakeholders in the property sector.
